Acceptance of processing of personal data
INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA AS PER SECTION 13 OF LEGISLATIVE DECREE JUNE 30, 2003 N° 196. Legislative Decree no. 196 of June 30, 2003 (hereinafter, the "Privacy Code"), which regulates the processing of personal data, provides that the data subject shall receive a prior information notice on the processing of his/her personal data. Therefore we hereby inform you as follows. Processing shall mean “any operation, or set of operations, carried out with or without the support of electronic or automated means, concerning the collection, recording, organisation, maintenance, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data, whether the latter are contained or not in a data bank“ (Section 4 paragraph 1 letter (a), Privacy Code). Personal Data shall mean "any information relating to natural or legal persons, bodies or associations that are or can be identified, even indirectly, by reference to any other information including a personal identification number" (Section 4 paragraph 1 letter (b), Privacy Code). 1) Collection of data Personal data (hereinafter the “Data”) processed by Valentino Fashion Group S.p.A. (hereinafter, the "Company") have been collected directly from You. The Data will be processed in compliance with the Privacy Code. 2) Processing purposes The Company intends to process your Data to evaluate your professional profile for recruitment purposes. In the absence of any express authorization from You or of an order issued by a public authority your Data will not be divulged nor disclosed. 3) Processing The processing of your Data will be carried out by electronic and non electronic means for the strict purposes of the processing and in order to grant the security and the confidentiality of your Data. The Data will be stored and processed in secure and appropriate places. In particular, the systems and software are studied and managed in order to limit the use and the processing of the Data, if not necessary. In any case, the Data are stored in order to limit as much as possible the risk of loss or non authorised access and non authorised or unlawful processing. 4) Compulsory disclosure of your Data and consequences of the refusal To the specific aim of Point 2) above, we hereby inform you that the disclosure of your Data is not compulsory, however, the possible refusal may imply the impossibility for the Company to evaluate your professional profile for recruitment purposes. 5) Subjects to which the Data can be disclosed The Company may disclose your Data for the limited purposes of Point 2) above to other companies within the Valentino Fashion Group, which will process your Data as independent data controller or as data processor. Your Data could also be communicated to consultants/employees of the Company, which will be duly appointed by the Company as data processors or as persons in charge of the processing. 6) Data Controllers and Data Processors The data controller is Valentino Fashion Group, with registered offices in Milan, via Turati 16/18. The relevant data processor is the HR Director and a complete and adjourned list of data processors is available at your request. 7) Data Subject's rights We hereby inform you that Section 7 of the Privacy Code grants you as Data subject the following rights. Such rights can be exercised by you in writing to the above mentioned address. "Section 7(Right to Access Personal Data and Other Rights) 1. A data subject shall have the right to obtain confirmation as to whether or not its personal data are collected, even if not already recorded, and the communication of such data in intelligible form. 2. A data subject shall have the right to be informed about: a) the source of the personal data; b) the purposes and methods of the processing; c) the logic applied to the processing, if the latter is carried out with the help of electronic means; d) the identification data concerning data controller, data processors and the representative designated as per Section 5(2); e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing. 3. A data subject shall have the right to obtain a) the updating, amendment or, if interested, the integration of its data; b) the cancelation or conversion into anonymous format or the blocking of its data which have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) the certification to the effect that the operations under a) and b) above have been notified, including their contents, to those subjects to which the data were communicated or disseminated, save that this formality proves to be impossible or would involve a manifestly disproportionate effort compared to the right that is to be protected. 4. A data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of its personal data, even though they are relevant for the purpose of the collection; b) to the processing of its personal data, where it is carried out for the purpose of sending advertising materials or direct selling or for the performance of market or commercial communication surveys". * Based on the information notice provided to you as per Section 13 of the Privacy Code (L. D. 196/2003), we hereby ask you to grant your explicit consent to the processing of your Data by the Company for the purposes and under the terms and conditions specified hereinabove.
